This article explores managers’ ethical reasoning for behaviors in price negotiations using evidence from 15 in-depth interviews conducted with sales and purchasing representatives in the chemical industry in Germany. Applying transaction cost economics, we find that negotiators in commoditized market-like exchanges either refer to deontological norms such as not to lie, or they neglect a role for ethics, arguing that distributive negotiation is per se opportunistic. In contrast, exchanges of products with higher asset specificity lead to stronger informational integration which (...) is supported with teleological justifications. Some negotiators use teleological justification to build business on trust rather than on economic safeguards as their firm norms would require. For negotiators, our results suggest considering institutional context and adjusting ethical reasoning to the negotiation situation. Firms need to recognize and find ways to address the potential conflicts of their internal norms with their frontline managers’ attempts to act in the firms’ best economic and ethical interests. Machine learning-driven clinical decision support systems (ML-CDSSs) seem impressively promising for future routine and emergency care. However, reflection on their clinical implementation reveals a wide array of ethical challenges. The preferences, concerns and expectations of professional stakeholders remain largely unexplored. Empirical research, however, may help to clarify the conceptual debate and its aspects in terms of their relevance for clinical practice. This study explores, from an ethical point of view, future healthcare professionals’ attitudes to potential changes of responsibility and decision-making (...) authority when using ML-CDSS. Twenty-seven semistructured interviews were conducted with German medical students and nursing trainees. The data were analysed based on qualitative content analysis according to Kuckartz. Interviewees’ reflections are presented under three themes the interviewees describe as closely related: (self-)attribution of responsibility, decision-making authority and need of (professional) experience. The results illustrate the conceptual interconnectedness of professional responsibility and its structural and epistemic preconditions to be able to fulfil clinicians’ responsibility in a meaningful manner. The study also sheds light on the four relata of responsibility understood as a relational concept. The article closes with concrete suggestions for the ethically sound clinical implementation of ML-CDSS. (shrink)

Jahrhundert immer weiter nach Europa vordrangen und die Christenheit eine militärische Niederlage nach der anderen kassierte, entwickelte seit dem Basler Konzil (1431-1449) eine Gruppe führender Philosophen, Humanisten und Theologen eine Alternative zu Krieg und Kreuzzügen: die friedliche Bekehrung der Muslime. Ein Netzwerk um Nikolaus von Kues, Heymericus de Campo, Johannes von Segovia, Enea Silvio Piccolomini und Georg von Trapezunt erarbeiteten mit- und gegeneinander höchst originelle philosophische und rhetorische Argumentationen. Beispielsweise erdachten sie Pläne für eine Friedenskonferenz (...) mit den Muslimen und versuchten, den Koran selbst gegen den Islam ins Feld zu führen, womit sie übrigens die Basis für die Islamstudien der Neuzeit legten. Dieses Buch handelt von einem spannenden propagandistischen Feldzug und gewährt neue Einblicke in Geschichte, Gedankenwelt und Islamrezeption des Spätmittelalters und der Renaissance. (shrink)

Emergency situations require individuals to make important changes in their behavior. In the case of the COVID-19 pandemic, official recommendations to avoid the spread of the virus include costly behaviors such as self-quarantining or drastically diminishing social contacts. Compliance (or lack thereof) with these recommendations is a controversial and divisive topic, and lay hypotheses abound regarding what underlies this divide. This paper investigates which cognitive, moral, and emotional traits separate people who comply with official recommendations from those who don't. In (...) four studies (three pre-registered) on both U.S. and French samples, we found that individuals' self-reported compliance with official recommendations during the COVID-19 pandemic was partly driven by individual differences in moral values, disgust sensitivity, and psychological reactance. We discuss the limitations of our studies and suggest possible applications in the context of health communication. (shrink)

During the last years, there has been an increasing discussion on the role of business in human rights violations and an increase in human rights litigation against companies. The result of human rights litigation has been rather disillusioning because no corporation has been found guilty and most cases have been dismissed. We argue that it may nevertheless be a useful instrument for the advancement of the business and human rights agenda. We examine the determinants of successful human rights litigation in (...) terms of judicial, educational, and regulatory effects. This article reviews more than 40 corporate foreign direct liability cases and their effects on corporate human rights policies and conduct. The review shows that most corporations adjusted their human rights policies and adopted additional measures to cope with human rights issues during or shortly after the legal proceedings. Opening legal channels for human rights litigation may be one way for governments to incentivize firms to respect human rights. These findings have implications for the United Nations Guiding Principles on Business and Human Rights as well as on our interpretation of the most recent U.S. Supreme Court decision in Kiobel v. Since 1989, clinical ethics consultation in form of hospital ethics committees was established in most of the transition countries of Central and Eastern Europe. Up to now, the similarities and differences between HECs in Central and Eastern Europe and their counterparts in the U.S. and Western Europe have not been determined. Through search in literature databases, we have identified studies that document the implementation of clinical ethics consultation in Central and Eastern Europe. These studies have been analyzed under the following (...) aspects: mode of establishment of HECs, character of consultation they provide, and their composition. The results show that HECs in the transition countries of Central and Eastern Europe differ from their western-European or U.S. counterparts with regard to these three aspects. HECs were established because of centrally imposed legal regulations. Little initiatives in this area were taken by medical professionals interested in resolving emerging ethical issues. HECs in the transition countries concentrate mostly on review of research protocols or resolution of administrative conflicts in healthcare institutions. Moreover, integration of non-professional third parties in the workings of HECs is often neglected. We argue that these differences can be attributed to the historical background and the role of medicine in these countries under the communist regime. Political and organizational structures of healthcare as well as education of healthcare staff during this period influenced current functioning of clinical ethics consultation in the transition countries. Georg Simmels philosophisches Werk steht quer zu etablierten Fachgrenzen. Das gilt auch für die "Philosophie des Geldes", in dem sein Interesse an unterschiedlichen Phänomenen des Sozial- und Kulturlebens – Freiheit, Weltanschauung, Gesellschaft, Politik, Religion, Kunst u.v.m – sich bereits abzeichnet, bevor es in den folgenden Jahren in Schriften zur Soziologie, Psychologie, Ästhetik, Kulturtheorie entfaltet wird. Schon der Titel einer "Philosophie des Geldes" ist ein Novum. Hier wird nämlich ein Bereich des sozialen Lebens, das wirtschaftliche Leben, zum Gegenstand der Analyse gemacht, (...) um nicht die Einheit des kulturellen Lebens, sondern um dessen geistige Grundlagen zu untersuchen. In der Selbstanzeige des Buches für den Verlag Duncker & Humblot schreibt Simmel, dass er mehrere Zielsetzungen verfolgt. Zum einen will er die Einseitigkeiten von Idealismus und Materialismus korrigieren und Geschichte respektive Kultur als ein Wechselspiel zwischen materiellen und ideellen Faktoren begreifen. Zum anderen will er den Beweis führen, dass sich von jedem Punkte der gleichgültigsten, unidealsten Oberfläche des Lebens ein Senkbeil in seine letzten Tiefen des menschlichen lebens werfen lässt. Damit ist gemeint, dass jedes Lebensphänomen als ein Aspekt und ein Träger einer Einheit von Sinn angesehen werden kann. Die These ist, dass sich menschliches Leben als Sinngeschehen vollzieht, was sich in allen Lebensvollzügen – vom ästhetischen über das wirtschaftliche bis zum religiösen Handeln – überprüfbar sein muss. Die "Philosophie des Geldes" besteht aus zwei Teilen, einem analytischen und einem synthetischen Teil. Im analytischen Teil wird die systematische und historische Explikation einer allgemeinen Kulturtendenz dargestellt. Es geht um den Befund eines Nebeneinanders zweier Welten, dort die Natur und hier die Welt der Werte, die sich aufeinander beziehen und doch voneinander getrennt entwickeln. Auf die Welt der Werte bezogen, also unsere menschliche Welt, die wir im Denken und Handeln erzeugen und die wir sinnverstehend erschließen können spricht Simmel von einer Entwicklungstendenz, einem Übergang von Substanz- zu Funktionsvorstellungen – vom einem sich verändernden Gebrauch der Kategorien, beispielsweise Mittel/Zweck. Im synthetischen Teil geht Simmel auf die Probleme der menschlichen Lebensführung ein, wozu das Problem von Freiheit und Verpflichtung und auch die Frage gehört, wie wir unserem Leben eine Form geben können, Im instruktiven, das Werk abschließenden Kapitel über den Stil des Lebens mündet die Diagnose der modernen Kultur in die Überlegung, was es für uns heißen könnte, unter den bedingungen eines relativistischen Weltbildes dem eigenen Leben eine Form und Richtung zu geben. Die "Philosophie des Geldes" ist ein großes Werk der Philosophie, in dem es, diesseits der üblichen Trennung in theoretische und praktische Fragen der Philosophie, noch einmal um die letzten Probleme der Philosophie geht. In light of the increasing refusal of some parents to vaccinate children, public health strategies have focused on increasing knowledge and awareness based on a “knowledge-deficit” approach. However, decisions about vaccination are based on more than mere knowledge of risks, costs, and benefits. Individual decision making about vaccinating involves many other factors including those related to emotion, culture, religion, and socio-political context. In this paper, we use a nationally representative internet survey in the U.S. to investigate socio-political characteristics to assess (...) attitudes about vaccination. In particular, we consider how political ideology and trust affect opinions about vaccinations for flu, pertussis, and measles. Our findings demonstrate that ideology has a direct effect on vaccine attitudes. In particular, conservative respondents are less likely to express pro-vaccination beliefs than other individuals. Furthermore, ideology also has an indirect effect on immunization propensity. The ideology variable predicts an indicator capturing trust in government medical experts, which in turn helps to explain individual-level variation with regards to attitudes about vaccine choice. The doctor-patient relationship is examined an emphasis on the comparison between professional and moral principles. Many therapeutic measures have opposite-directed alternative steps with an equal degree of justification, so that no logical preference is attainable and conflicts ensue. Thus patients come for relief and are ordered to endure further pain and discomfort; or weaker individuals exaggerate their complaints hypochomdriacally, and thus need a great deal of understanding, yet paradoxically they are prone to receive less support than stronger ones. Further conflicts (...) arise between our devotion to human well-being and dignity, and our obligation to disrespect some of their rights for self-determination. Furthermore, various dutifully performed doctoring activities run counter to our own social needs and interests; last, but not least, human imperfection colours some of our decisions, putting a definite blemish on their value. In conclusion, physicians must bear the constant burden of paradoxically-opposed alternatives, and they confront pitfalls of worongdoing at every therapeutic step. Three early 20th-century attempts at unifying separate areas of biology, in particular development, genetics, physiology, and evolution, are compared in regard to their success and fruitfulness for further research: Jacques Loeb’s reductionist project of unifying approaches by physico-chemical explanations; Richard Goldschmidt’s anti-reductionist attempts to unify by integration; and Sewall Wright’s combination of reductionist research and vision of hierarchical genetic systems. Loeb’s program, demanding that all aspects of biology, including evolution, be studied by the methods of the experimental sciences, proved highly (...) successful and indispensible for higher level investigations, even though evolutionary change and properties of biological systems up to now cannot be fully explained on the molecular level alone. Goldschmidt has been appraised as pioneer of physiological and developmental genetics and of a new evolutionary synthesis which transcended neo-Darwinism. However, this study concludes that his anti-reductionist attempts to integrate genetics, development and evolution have to be regarded as failures or dead ends. His grand speculations were based on the one hand on concepts and experimental systems that were too vague in order to stimulate further research, and on the other on experiments which in their core parts turned out not to be reproducible. In contrast, Sewall Wright, apart from being one of the architects of the neo-Darwinian synthesis of the 1930s, opened up new paths of testable quantitative developmental genetic investigations. He placed his research within a framework of logical reasoning, which resulted in the farsighted speculation that examinations of biological systems should be related to the regulation of hierarchical genetic subsystems, possibly providing a mechanism for development and evolution. I argue that his suggestion of basing the study of systems on clearly defined properties of the components has proved superior to Goldschmidt’s approach of studying systems as a whole, and that attempts to integrate different fields at a too early stage may prove futile or worse. © 2011 Elsevier Inc. Upshot: The response starts with a clarification of certain points that commentators found insufficiently articulated and then goes on to discuss some of the suggested solutions, all of which are seen as welcome improvements to the original proposal. The need for establishing a research environment acknowledging and nurturing the non-trivial character of experience is emphasised.

We explore the connections between Dickson’s lemma and weak Ramsey theory. We show that a weak version of the Paris–Harrington principle for pairs in c colors and miniaturized Dickson’s lemma for c-tuples are equivalent over \. Furthermore, we look at a cascade of consequences for several variants of weak Ramsey’s theorem.
